Uniform Construction Code Board of Appeals

UCC Board of Appeals

The UCC Appeals Board hears and rules on appeals, requests for variances and requests for extensions of time under the Uniform Construction Code.  An application for appeal to the Municipal Appeals Board is based on a claim that the true intent of the Pennsylvania Construction Code Act (35 P.S. §§ 7210.101 - 7210.1103),  or the Uniform Construction Code has been incorrectly interpreted, the provisions of the Act or Uniform Construction Code do not fully apply or an equivalent form of construction is to be used.

Any municipality that is a dues paying full member of the QVCOG in good standing may elect to join the QVCOG Municipal Appeal Board .

Member of the Municipal Appeals Board are qualified by training and experience to pass on matters pertaining to building construction. No member or alternate member may be recommended by a participating municipality to the QVCOG Municipal Appeals Board unless the member or alternate member possesses a minimum of five (5) years combination of education and experience in the building trades.  Member of the Appeals Board receive no compensation.

An owner or owner’s agent may seek a variance or extension of time or appeal a building code official’s decision by filing a petition with the building code official or other person designated by the Municipal Appeals Board on a form provided by the municipality and approved by the Municipal Appeals Board.  All requests for variances, extension of time or appeals shall be filed no later than thirty (30) days of the determination.

The QVCOG UCC Board of Appeals Bylaws specify the operations of the Board.
